IBBI, not NCLT, is the competent body to act against resolution professionals

The National Company Law Appellate Tribunal in Dhinal Shah vs Bharati Defence Infrastructure Ltd. has decided that it would be The Insolvency and Bankruptcy Board of India who would be the competent authority and not the National Company Law Tribunal (NCLT) to act against any resolution professional (RP) for dereliction of duty.
