Arbitration – Enforcement Court Can Refuse To Enforce Foreign Award

In GOVERNMENT OF INDIA vs VEDANTALIMITED (Formerly Cairn India Ltd.), the Supreme Court has observed that though enforcement courts may “refuse” enforcement of a foreign award, if the conditions contained contained in Section 48 are made out, but it cannot set aside or correct a foreign award, even if such conditions are made out.
