‘Duty to care’ covers the duty to not provide misleading information

In Darnley v Croydon Health Services NHS Trust, a five-judge bench comprising of Lady Hale, Lord Reed, Lord Kerr, Lord Hodge, and Lord Lloyd-Jones while hearing an appeal pertaining to breach of duty held that the scope of the duty of care of a hospital extends to not providing misleading information.

In this matter, a person with head injury had gone to the hospital and was advised waiting time of 4-5 hours while its usual 30 mins and the man left but his problem worsened with the hour and was readmitted.
